Product Warranty
1. Scope of Warranty
1.1 This Warranty is offered by AJ Sells Ltd. You can find our contact details at the end of this document.
1.2 In this Warranty, if you are a “consumer” under the Consumer Rights Act 2015:
(a) we provide this Warranty to you in addition to any rights or remedies you have under the Consumer Rights Act 2015 or any other applicable consumer law (Consumer Law Rights);
(b) this Warranty does not replace or limit any remedy you have pursuant to your Consumer Law Rights, which you may exercise free of charge;
(c) your Consumer Law Rights may extend beyond the Warranty Period; and
(d) you can get more information about your Consumer Law Rights at Citizen’s Advice.
1.3 Subject to the terms of this Warranty:
(a) if during the period of 12 months from the date of purchase of any of the following products from us (Warranty Period):
- 6-in-1 Sonic Electric Toothbrush
- Water Flosser Pro
- Ultrasonic Tooth Cleaner
(together, the Electrical Devices), an Electrical Device proves defective by reason of improper workmanship or materials, we will repair or replace the Electrical Device, or if that is not possible, issue a full or partial refund to you with respect to any amount paid for the defective part (or all) of the Electrical Devices;
(b) Consumable Products: Our consumable products (including whitening strips, whitening gels, serums, floss, and tongue scrapers) (Consumable Products) are warranted to be fit for their intended purpose at the time of delivery only. No warranty as to durability, longevity, or continued performance is given in respect of Consumable Products, and the Warranty Period in clause 1.3(a) does not apply to Consumable Products.
1.4 Extended Christmas Warranty (Electrical Devices only): Where an Electrical Device is purchased from us between 1 November and 25 December in any given year (the Christmas Purchase Window), the Warranty Period for that Electrical Device shall commence on 1 January of the following year, rather than the date of purchase (the Extended Christmas Warranty). The Extended Christmas Warranty applies to Electrical Devices only. It does not apply to Consumable Products or any other products (other than the Electrical Devices) sold by us. All other terms of this Warranty apply to the Extended Christmas Warranty without modification.
1.5 Charging Guidance: Each Electrical Device is supplied with a charging cable. We do not supply a plug or power adapter. To protect your Electrical Device and maintain the benefit of this Warranty, we strongly recommend that you use only a plug or power adapter that:
(a) is certified to applicable UK safety standards (including BS 1363 for UK mains plugs);
(b) is compatible with the input voltage and current requirements specified for your Electrical Device (as set out in the product documentation); and
(c) bears the UKCA or CE mark, or equivalent recognised certification mark.
Use of a non-compliant or incompatible plug or power adapter may damage your Electrical Device and will void this Warranty in accordance with clause 3.1.
1.6 If any materials, parts or features required to facilitate any repair or replacement pursuant to clause 1.3 are unavailable or no longer in production, or your model of the Electrical Device is no longer available or in production, we will use our best endeavours to use appropriate equivalent materials, parts, features or model.
1.7 Where products are sold as part of a package] We offer the products as part of a package deal or bundle to give you the best value. Goods included in our package and bundle deals may also be available for individual purchase, and each product in the package can generally be used without the other products. Where you purchase products as part of a package or a bundle deal, and a product in the package is deemed defective under this Warranty, we will repair or replace that product or issue a partial refund to you in respect of the value of that product in the package only. The value of a particular products in a package may be less than its full value had you purchased the products individually. For the avoidance of doubt, we will not issue a refund for the other products in the package which are not defective.
2.Making a valid warranty claim.
2.1 To claim the benefit of this Warranty, you must:
(a) notify us by email as soon as you become aware that the Electrical Device is defective, and in any event, within 28 days of when you become aware that the Electrical Device is defective, with evidence of proof of purchase of the Electrical Device is from us and a description and photographs of the claimed defect
(b) if we ask you to, you must return the Electrical Device to us together with all packaging, parts, accessories and documentation to the contact details set out below; and
(c) provide any other information reasonably required by us to assess your claim.
2.2 Where you return the Electrical Device to us as part of a Warranty claim, you will need to cover any associated delivery costs of you returning the Electrical Device to us. We recommend using a trusted and tracked delivery method to return the Electrical Device to us.
2.3 Where we accept your claim under this Warranty, clause 1.3 will apply.
3.When this warranty applies and when it does not.
3.1 This Warranty does not cover any defect which is caused (or partly caused) or contributed to, by any:
(a) act or omission, accident, or negligence by you or any third party not engaged by us (including any third party installer of the Electrical Device);
(b) failure on your part to follow any instructions or guidelines (including any manual) provided in relation to the Electrical Device or properly maintain the Electrical Device in accordance with any of our instructions or guidelines;
(c) use of the Electrical Device otherwise than for any application or use specified by us or our personnel;
(d) continued use of the Electrical Device (where such use is not reasonable) after any defect in the product becomes apparent or would have become apparent to a reasonably prudent person;
(e) incorporation or installation of fixtures, appliances, or other items into the Electrical Device;
(f) use of any third-party plug, adapter, power supply, or charging device (other than the charging cable supplied by us) in connection with the Electrical Device. We supply a charging cable with each Electrical Device; however, we do not supply a plug or power adapter. You are responsible for ensuring that any plug, adapter, or power supply you use to charge your Electrical Device is certified to applicable UK safety standards (including BS 1363 for UK plugs) and is compatible with the Electrical Device's specified input requirements. To the maximum extent permitted by law, we accept no liability for any damage to an Electrical Device caused or contributed to by the use of a non-compliant, incompatible, or uncertified plug, adapter, or power supply, whether or not such damage is discovered during the Warranty Period;
(g) failure by you to notify us of any defect in the Electrical Device within a reasonable period of time after you become aware of or ought to have reasonably become aware of the relevant defect;
(h) exposure of the Electrical Device to water, liquid, or moisture beyond any ingress protection rating specified for that product, or charging of the Electrical Device in a manner inconsistent with our instructions or guidelines (including use of an incompatible power source or voltage);
(i) reasonable wear and tear;
(j) act of God or force majeure event (including but not limited to war, riot, invasion, act of terrorism, contamination, earthquake, flood, fire, or other natural disaster, or any other event or circumstance beyond our or our personnel’s reasonable control); or
(k) installation, repair, replacement, maintenance, altering, or otherwise compromise of the Electrical Device by you or any person other than us.
3.2. Additional Expenses: Any works or services requested by you to be performed by us and deemed by us to not be covered under this Warranty may incur additional charges, which we will advise you of prior to commencing those additional work or services, including providing you with a quote for any repair or replacement. We are under no obligation to perform any additional work or services that you may request.
4. General
4.1 Terms and Conditions prevails: This Warranty is subject to our Terms and Conditions, and in the event of any inconsistency or ambiguity between this Warranty and our Terms and Conditions, our Terms and Conditions will prevail.
4.2 Enforceability: This Warranty is only valid and enforceable in the United Kingdom.
4.3 Governing Law: This Warranty is governed by the laws of England and Wales. Each Party irrevocably and unconditionally submits to the exclusive jurisdiction of the courts operating in England and Wales and any courts entitled to hear appeals from those courts and waives any right to object to proceedings being brought in those courts.
4.4 Contracts (Rights of Third Parties) Act 1999: Notwithstanding any other provision of this Warranty, nothing in this Warranty confers or is intended to confer any right to enforce any of its terms on any person who is not a party to it.
4.5 No Assignment or transfer: This Warranty or the benefit under this Warranty cannot be assigned or transferred to any other person or third party.
4.6 Severance: If any provision of this Warranty is held to be void, invalid or illegal or unenforceable in any jurisdiction, that provision is to be read down as narrowly as necessary to allow it to be valid or enforceable, failing which, that provision (or part of that provision) will be severed from this Warranty without affecting the validity or enforceability of the remainder of that provision or the other provisions in this Warranty.
